ok further digging, if I change the BA_Volume_solid Light/Shadow internal shadow mode from
'one single trace to volume BBox' to 'Full Raytrace' it works fine. sorry if this is covered in help file ...

On XSI 7.01 with latest volume shader 3.6.2 for xsi7 and latest essentials.

do a render region > instant crash 'successfully saved scene before system failure'

if I disconnect the BA_fractal ...
